1. Introduction

Welcome to OpenGig. These Terms of Service govern your use of our website, apps, and services. By accessing or using our service, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Definitions

  • "Service" refers to the OpenGig website, applications and other related services.

  • "User" refers to individuals who access or use the Service.

  • "Freelancer" refers to users who offer services on the platform.

  • "Client" refers to users who purchase services from Freelancers.

  • "Content" refers to text, graphics, images, music, software, audio, video, and other material.

3. User Accounts

When you create an account with us, you must provide accurate, complete, and up-to-date information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

4. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of OpenGig and its licensors.

Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of OpenGig.

5. User Content

You retain all rights to any content you submit, post, or display on or through the Service. By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, and distribute such content.

You represent and warrant that you own or have the necessary rights to the content you post and that the content does not violate the rights of any third party.

6. Payments

All payments for services are processed through our platform. We charge a service fee on transactions between Clients and Freelancers.

You agree not to circumvent the payment methods offered by the Service and not to contact other Users to pay outside the platform.

Prices for services are set by Freelancers and are listed in the currency chosen by the Freelancer.

7. Refunds and Cancellations

Refunds and cancellations are handled according to our Refund Policy, which is incorporated by reference into these Terms of Service.

We reserve the right to issue refunds or credits at our sole discretion.

8. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

9. Limitation of Liability

In no event shall OpenGig, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
